These terms govern your use of the Nimblechapps Security website (security.nimblechapps.com) and the services we provide through it. By using this site or engaging our services, you agree to these terms. They are subject to change at the discretion of Nimblechapps.
Scope of work and modifications
The scope of any engagement is agreed before work begins. Minor adjustments within the agreed scope are handled as part of the work. Changes beyond the original requirements are treated as additional work and may be charged accordingly, whether requested during the engagement or after delivery.
Payments
Payment terms are agreed per engagement. We may accept payment through bank transfer and common online payment platforms. We reserve the right to set and change payment methods and pricing without prior notice. If a client cancels or discontinues an engagement midway, cancellation charges may apply in line with the nature of the work. We reserve the right to take legal action for non-payment of overdue amounts or cancellation charges.
Approvals and delivery
Where an engagement is divided into stages, work on the next stage begins once the agreed payment for the completed stage is made. We will do our best to meet agreed deadlines, but we are not responsible for delays caused by circumstances beyond our control, including force majeure, communication delays, resource unavailability, or third-party dependencies.
Third-party access
Where an engagement requires access to a client's third-party accounts, servers, or services, the client is responsible for providing the necessary access. Other resources may need to be configured depending on the size and nature of the project, which we will communicate as needed.
Intellectual property
Copyright to files, data, logos, photographs, graphics, text, and similar materials provided by the client remains owned by the client. Securing rights to any third-party material is the client's responsibility. Nimblechapps is not liable for claims arising from materials the client provides, and is not responsible for changes made by the client or a third party to materials we deliver.
Acceptable use
We expect visitors and clients not to use language or conduct that is abusive, or that promotes hatred, harassment, or illegal activity. We reserve the right to remove any content that violates this and to refuse service in such cases.
Limitation of liability
Nimblechapps is not liable for any direct, indirect, incidental, or consequential loss or damage, including loss of data, profits, or business, arising from the use of this site or our services, except where such liability cannot be excluded by law.
Governing law and jurisdiction
These terms are governed by the laws of India and the state of Gujarat. Any disputes arising from these terms are subject to the exclusive jurisdiction of the courts of India.
Changes to these terms
We may update these terms at any time. Continued use of the site or our services after changes means you accept the updated terms.
